Damini/ Nibhaya – Juvenile accused case

Seriously I still fail to understand why do rapists, who actually get caught not get inhuman punishments when they do inhuman crimes. Why our  judiciary system have so much empathy with criminals, they offered  good food, security to them??? even in capital punishment they have rule and regulation so that accused don’t hurt. Why our judiciary system is so weak??? When our Constitution of India is the lengthiest constitution in the world as no other constitution has as many articles(it has 395 Articles and 12 Schedules. A number of amendments, (about 96) passed since its enforcement in 1950, have also become a part of the Constitution, where as  constitution of  USA has 7 Articles, of China 138, Japanese 103, and Canadian 107 Articles).

According to me amendment  should be done to the Juvenile Justice act . Let’s assume he has a proper birth certificate which says he was 17 years and 364 days old when he committed that heinous crime. Suppose if  he done the same thing one day later, he would have been given life imprisonment if not capital punishment. How is that okay if a two Days time change the fate of a “juvenile” offender? Does that mean a guy can do anything at his 17 th year and escape with minimum imprisonment?

at last I wind up by this poem-

Ho gayi hai peer parvat si, pighalni chahiye,

Is himalaya se bhi koi ganga nikalni chahiye

Mere seene mein nahi, to tere seene mein sahi,

Ho kahin bhi aag, par aag jalni chahiye.
